Advance approval (Vorabzustimmung) for the visa

Ausländerbehörde · Residence law

Via the employer Make it in Germany

The advance approval (Vorabzustimmung) is the approval by the German Ausländerbehörde (foreigners authority) of the issue of a national visa (category D visa), given before the skilled worker submits their visa application abroad. The legal basis is § 31 Abs. 3 of the Ordinance Governing Residence (Aufenthaltsverordnung, AufenthV). The German mission abroad then no longer has to obtain the involvement of the Ausländerbehörde during the ongoing visa procedure – the most time-consuming part has already been dealt with.

Two routes must be distinguished, and they are often mixed up online: the simple Vorabzustimmung under § 31 Abs. 3 AufenthV, for which the Ordinance Governing Residence provides no separate fee, and the fee-based fast-track procedure for skilled workers (beschleunigtes Fachkräfteverfahren) under § 81a of the Residence Act (Aufenthaltsgesetz, AufenthG), which only the employer can apply for, on behalf of the skilled worker under a power of attorney, and which costs €411.00 under § 47 Abs. 1 AufenthV. Both routes noticeably shorten the process, but neither replaces the visa application or the visa fee of €75.00 – and neither leads to a visa “within a few days”: in the fast-track procedure, after the Vorabzustimmung the German mission abroad offers an appointment that falls within three weeks and then, as a rule, decides within a further three weeks (§ 31a AufenthV); there are no such deadlines for the simple Vorabzustimmung.

Legal framework

Two procedures that are constantly confused

Simple Vorabzustimmung – § 31 Abs. 3 AufenthV, no separate fee

The Ausländerbehörde can approve the issue of the national visa before the application is submitted to the German mission abroad. § 31 Abs. 3 AufenthV names several situations for this by way of example: an entitlement to the issue of the residence title, a public interest, the cases under §§ 18a, 18b, 18c Abs. 3, 19, 19b, 19c and 21 AufenthG, insofar as approval by the Ausländerbehörde is provided for in them, and urgent cases. In practice, this frequently concerns skilled workers whose qualification has already been recognised, researchers or applicants for an EU Blue Card (Blaue Karte EU). The Ordinance Governing Residence provides no separate fee for this: §§ 44 to 52 AufenthV contain no fee item for the approval of the Ausländerbehörde under § 31 AufenthV. Nor is there a uniform nationwide processing deadline – how quickly your authority decides depends on the authority and on the state of the file.

Fast-track procedure for skilled workers – § 81a AufenthG, €411.00

This is the formal, fee-based procedure: under § 81a Abs. 1 AufenthG, employers can apply for a fast-track procedure for skilled workers “on behalf of the foreigner under a power of attorney”. In this procedure, the Ausländerbehörde bundles the recognition of the foreign qualification, the approval of the Federal Employment Agency (Bundesagentur für Arbeit) and the approval of the issue of the visa, and supports the employer as the central point of contact. Under § 47 Abs. 1 AufenthV, a fee of €411.00 is charged “for carrying out the fast-track procedure for skilled workers under § 81a of the Residence Act”, which the employer bears. The procedure is designed not to exceed a total of around four months.

The deadlines laid down by law

Only a few specific deadlines are laid down by law; everything else is based on experience. First: if the recognition body requests further proof or its findings are received, the Ausländerbehörde, under § 81a Abs. 3 Satz 1 Nr. 3 AufenthG, invites the employer within three working days of receipt so that these can be handed over and the further course of the procedure discussed; there is no deadline running from receipt of the application. Second: once the Vorabzustimmung has been presented and the appointment request has been received, the German mission abroad in the fast-track procedure offers an appointment for submitting the visa application that falls within three weeks, and then, as a rule, decides within a further three weeks of the complete visa application being submitted (§ 31a AufenthV). Separate deadlines also apply to the recognition body, for example under § 14a of the Professional Qualifications Assessment Act (Berufsqualifikationsfeststellungsgesetz, BQFG), and to the Federal Employment Agency under § 36 Abs. 2 of the Ordinance on the Employment of Foreigners (Beschäftigungsverordnung, BeschV). The frequently quoted ten-day rule of § 31 Abs. 1 AufenthV, on the other hand, only concerns certain cases in the regular visa procedure: there, approval is deemed to have been granted if, within ten days of the transmission of the application data, the Ausländerbehörde neither objects nor notifies that the examination will take longer – it does not apply to the Vorabzustimmung.

What the Vorabzustimmung is not

The Vorabzustimmung is not a visa and no guarantee of one. It merely anticipates the involvement of the Ausländerbehörde; the decision on the visa application continues to rest with the German mission abroad, which independently examines identity, travel document, security concerns and the general requirements for issue. Nor is it identical to the approval of the Federal Employment Agency: these are two separate examinations that are merely coordinated by the same body in the fast-track procedure. And it does not replace the later residence title, which must be applied for at the Ausländerbehörde after entry.

Required documents

The proof that the Ausländerbehörde requires

Power of attorney from the skilled worker (original or scan)

§ 81a Abs. 1 AufenthG expressly allows the employer to apply only “on behalf of the foreigner under a power of attorney”. Without this power of attorney in writing, the Ausländerbehörde must not process the application, nor must it give the employer any information about its status. The skilled worker signs it abroad; many Ausländerbehörde offices provide their own form for this, which you should request before the consultation. A scan is often sufficient to start the procedure, but the signed original is usually requested later.

Employment contract or binding job offer

The employer presents the signed employment contract or a binding offer. It must show the activity, working hours, remuneration, any fixed term and the planned start date, because the Ausländerbehörde and the Federal Employment Agency use this information to check whether the employment matches the qualification and whether the working conditions are no less favourable than those of comparable domestic employees. The document comes from your own company; certification is usually not necessary, but a legally binding signature is. If the contract changes during the procedure, you must inform the authority immediately.

Proof of the qualification

You need the certificate of the university degree or vocational qualification together with a transcript of subjects and grades; for vocational training, also the proof of training and certificates of relevant professional experience. Documents in a foreign language must be submitted with a certified German translation; whether legalisation or an apostille is required depends on the issuing country. Whether a foreign university degree is already considered comparable can be checked in advance in the anabin database of the Central Office for Foreign Education (Zentralstelle für ausländisches Bildungswesen, ZAB) – a certificate listed there shortens the procedure considerably.

Application for recognition or for a licence to practise the profession

For qualifications that have not been recognised, the Ausländerbehörde initiates the recognition procedure with the competent body in the fast-track procedure – depending on the profession, this is for example the Handwerkskammer (chamber of skilled crafts, HWK), the Chamber of Industry and Commerce (Industrie- und Handelskammer, IHK) or a Land (federal state) authority. In regulated professions, especially in health, nursing and teaching professions, the licence to practise the profession is also required; without it, the activity must not be taken up. This partial procedure incurs separate fees of the recognition body, which are not included in the €411.00.

Declaration on the employment relationship (Erklärung zum Beschäftigungsverhältnis)

The employer fills in this form of the Federal Employment Agency; it is the working basis for the Federal Employment Agency’s approval of the employment. Among other things, it asks for the place of work, weekly working hours, gross pay, holiday entitlement and the exact job description. You can obtain it via the Ausländerbehörde or directly from the Federal Employment Agency. If the form is missing or the information differs from the employment contract, the Ausländerbehörde cannot obtain the approval and the entire procedure stalls.

Copy of the skilled worker’s passport

A copy of a valid and recognised passport must be submitted, usually the data page, in some cases also pages with previous visas or entry stamps. The remaining validity should, if possible, cover the planned duration of residence – a passport that expires shortly after entry means that the visa can only be issued for a correspondingly shorter period. The passport is issued by the skilled worker’s home country authority; obtaining it takes several weeks in some countries and should therefore begin in parallel with the procedure.

Proof concerning the company

The Ausländerbehörde checks whether the employer actually exists and whether the job is real. Usual documents are a current extract from the commercial register (Handelsregisterauszug), the trade registration (Gewerbeanmeldung) or proof of the business premises, in some cases supplemented by information on the number of employees. You can obtain the register extract via the joint register portal of the federal states, and you will already have the trade registration from your own registration with the Gewerbeamt (trade office). The authority specifies which proof is actually required in the agreement under § 81a Abs. 2 AufenthG.

Proof of subsistence, age and health insurance

Subsistence must be secured through the employment; the agreed gross pay is decisive. If the skilled worker has reached the age of 45 when a residence title under § 18a or § 18b AufenthG is issued for the first time, § 18 Abs. 2 Satz 1 Nr. 5 AufenthG additionally requires either a minimum salary or proof of adequate retirement provision; the relevant salary threshold is adjusted annually, and you can ask the competent Ausländerbehörde for the current amount. For the period until statutory health insurance coverage begins, sufficient insurance cover must also be proven.

Step by step

How the procedure works

  1. 1

    Determine the competent Ausländerbehörde

For the simple Vorabzustimmung, the competent authority is in principle the Ausländerbehörde at the skilled worker’s intended place of stay (§ 31 Abs. 1 AufenthV). In the fast-track procedure for skilled workers, § 31 Abs. 4 AufenthV expressly sets out jurisdiction: the competent authority is the Ausländerbehörde that is competent for the location of the business premises where the skilled worker is to be employed – this is not necessarily the authority at the company’s registered office. If the federal state (Bundesland) has set up a central Ausländerbehörde for skilled immigration (§ 71 Abs. 1 Satz 5 AufenthG), that authority is competent. Be sure to clarify jurisdiction by telephone or email before submission of the application – especially if there are several business premises or the place of residence is in another district. An application submitted to the wrong authority is forwarded, but this can easily cost several weeks.

  2. 2

Submit the application and attend the consultation

The employer submits the application on behalf of the skilled worker under a power of attorney; many Ausländerbehörde offices offer an online form or an inbox for employer enquiries for this purpose. The authority advises the employer on the procedure and on the proof to be submitted (§ 81a Abs. 3 Satz 1 Nr. 1 AufenthG); there is no statutory deadline for this consultation. The employer and the authority then conclude an agreement on the course of the procedure under § 81a Abs. 2 AufenthG: it records which documents must be submitted by when, which bodies are involved and who the contact person is on each side. The procedure formally begins with this agreement.

  3. 3

    Settle the fee notice

For carrying out the fast-track procedure for skilled workers, the Ausländerbehörde charges a fee of €411.00 under § 47 Abs. 1 AufenthV. It is invoiced to the employer and, as a rule, must be paid by bank transfer to the authority’s account. Many authorities only initiate the further steps once payment has been received – a late transfer delays the entire procedure without you noticing at first. Keep the proof of payment, as it is occasionally requested later in the procedure.

  4. 4

    Have the qualification recognised

If the foreign qualification has not yet been recognised, the recognition procedure is initiated with the competent body and supported by the Ausländerbehörde. For regulated professions, the licence to practise the profession is also needed. The law provides for accelerated processes for this part; how long it actually takes, however, depends on the recognition body concerned, the profession and the completeness of the certificates. Missing translations or documents that have to be submitted later are the most common cause of delays here, because the deadlines only start to run once the documents are complete.

  5. 5

Obtain the approval of the Federal Employment Agency

Where the specific employment requires approval, the Ausländerbehörde obtains the approval of the Federal Employment Agency – so the employer does not have to apply for it themselves. The check focuses above all on the working conditions: pay, working hours and holiday must not be less favourable than for comparable domestic employees. The basis is the declaration on the employment relationship (Erklärung zum Beschäftigungsverhältnis). If the information in it differs from the employment contract, there will be queries; in this case, the procedure is extended by the entire time taken by the queries. You can find more about this sub-step under work permit.

  6. 6

The Vorabzustimmung is granted and sent to the German mission abroad

Once recognition and approval have been obtained, the Ausländerbehörde grants the Vorabzustimmung for the issue of the visa and transmits it to the competent German mission abroad. The employer receives an official copy, which they forward to the skilled worker – the skilled worker should bring this proof to the visa appointment. The ten-day rule of § 31 Abs. 1 Satz 3 and 4 AufenthV plays no role here: it only applies in certain cases of the regular visa procedure in which the German mission abroad involves the Ausländerbehörde only after the submission of the application.

  7. 7

Get an appointment at the German mission abroad

In the fast-track procedure, once the Vorabzustimmung has been presented and the appointment request has been received, the competent embassy or consulate general offers an appointment for submitting the visa application that falls within three weeks (§ 31a Abs. 1 AufenthV). The skilled worker books the appointment themselves via the appointment system of the mission concerned, pointing out that a Vorabzustimmung has been granted. They must bring their valid passport, the completed application form for a national visa, biometric photographs in line with the mission’s requirements and the documents relating to the employment relationship. The deadline for the decision under § 31a Abs. 2 AufenthV only starts once the skilled worker attends the appointment offered and submits the complete application.

  8. 8

Apply for the visa, pay the fee and wait for the decision

As a rule, a decision on the visa application is made within a further three weeks of receipt of the complete documents. Realistically, therefore, around six weeks pass from the Vorabzustimmung to the visa – the widespread claim of “a few days” is not correct. Under § 46 AufenthV, the fee for the national visa is €75.00 and must be paid at the German mission abroad; the extension of a national visa costs €25.00. After entry, the skilled worker registers their address and, before the expiry of the visa, applies to the Ausländerbehörde for the electronic residence title.

Fee information

Costs and payment

Fees

Vorabzustimmung under § 31 Abs. 3 AufenthVNo separate fee – §§ 44 to 52 AufenthV contain no fee item for it
Fast-track procedure for skilled workers under § 81a AufenthG€411.00 (§ 47 Abs. 1 AufenthV) – paid by the employer
Recognition of the qualificationIn addition: fee of the recognition body concerned, depending on the federal state and the profession
National visa€75.00 (§ 46 AufenthV) – extension of a national visa €25.00
Place of paymentAusländerbehörde (employer) and German mission abroad (skilled worker)
Means of paymentAt the Ausländerbehörde, usually bank transfer after the fee notice; at the German mission abroad, depends on the mission concerned

The €411.00 is not a flat rate for everything. The wording of § 47 Abs. 1 AufenthV is clear: the fee is charged “for carrying out the fast-track procedure for skilled workers under § 81a of the Residence Act”. It therefore covers the procedure of the Ausländerbehörde, including advice and coordination – not the recognition procedure itself and not the visa. Always budget for the fee of the recognition body and the €75.00 visa fee in addition.

The fee pays for the procedure, not the result. It is charged for carrying out the procedure and is therefore also due if the recognition is negative or the visa is ultimately not issued. If you want to save these costs, check in advance in the anabin database whether the qualification is already listed as comparable – in clear cases of entitlement, the Vorabzustimmung under § 31 Abs. 3 AufenthV, which is free of charge, is often sufficient.

Who pays what. The €411.00 is borne by the employer who applied for the procedure; the law does not provide for passing it on to the skilled worker. The visa fee of €75.00, on the other hand, is paid by the skilled worker at the German mission abroad, usually on the day of submission of the application. If your company covers these costs voluntarily, record this in the employment contract or in a side agreement.

Good to know

Important notes

Realistic expectations instead of “a few days”. The Vorabzustimmung considerably shortens the visa procedure, because the involvement of the Ausländerbehörde is dealt with in advance. However, it does not lead to the visa being issued within days: even in the fast-track procedure for skilled workers, § 31a AufenthV provides for three weeks for allocating an appointment and, as a rule, a further three weeks for the decision from the submission of the complete application. Therefore plan the start of employment with a buffer of at least six weeks from the Vorabzustimmung.

The ten-day rule of § 31 AufenthV. It only applies in certain cases of the regular visa procedure: if the approval requirement is based on a security check ordered by the Federal Ministry of the Interior (BMI), or if the visa – for example for other employment, research under § 18d AufenthG, training or studies – requires approval only because of a previous stay with a Duldung (temporary suspension of deportation) or an Aufenthaltsgestattung (permission to remain pending the asylum decision), or because of previous measures to terminate residence (§ 31 Abs. 1 Satz 3 and 4 AufenthV). In these cases, approval is deemed to have been granted if the Ausländerbehörde does not object within ten days of the transmission of the application data. The deadline only starts to run once the German mission abroad has transmitted the data, and the authority can stop it by notifying within the ten days that the examination will take longer. The rule does not apply to the Vorabzustimmung.

Three working days after notification from the recognition body. This deadline in the fast-track procedure is binding on the authority, but it does not run from receipt of the application: if the recognition body requests further proof or its findings are received, the Ausländerbehörde must, under § 81a Abs. 3 Satz 1 Nr. 3 AufenthG, invite the employer within three working days of receipt so that these can be handed over and the further course of the procedure discussed. It must send you the recognition body’s confirmations of receipt and of completeness without delay – keep them so that you can follow up on a factual basis if you hear nothing.

Deadlines only run once the documents are complete. Both at the recognition body and at the German mission abroad, the deadline for a decision only starts once the documents are complete. A missing certified translation, an unsigned form or a differing salary figure in effect resets the clock. Therefore, submit too much rather than too little, and answer queries immediately.

When a Vorabzustimmung can be considered at all. § 31 Abs. 3 AufenthV names, by way of example, an entitlement to the issue of a residence title, the public interest, the cases under §§ 18a, 18b, 18c Abs. 3, 19, 19b, 19c and 21 AufenthG, insofar as approval by the Ausländerbehörde is provided for in them, and urgent cases. The provision does not give rise to an enforceable entitlement to the Vorabzustimmung – the decision is at the discretion of the competent Ausländerbehörde. The fast-track procedure for skilled workers is different: if all requirements are met, it is the task of the authority under § 81a Abs. 3 Satz 1 Nr. 6 AufenthG to approve the issue of the visa in advance without delay.

Clarify jurisdiction beforehand. For the simple Vorabzustimmung, the relevant authority is the Ausländerbehörde at the skilled worker’s intended place of stay; in the fast-track procedure, under § 31 Abs. 4 AufenthV it is the authority competent for the location of the business premises where the skilled worker is to work – with group structures and branches, therefore, not necessarily the authority at the company’s registered office. If the federal state has set up a central Ausländerbehörde for skilled immigration, that authority is competent. A short enquiry in writing in advance saves weeks, because an application submitted to an authority that is not competent must first be forwarded.

Raise the question of accompanying family members early. Under § 81a Abs. 4 AufenthG, the fast-track procedure also covers family reunification of the spouse and of minor unmarried children whose visa applications are submitted at around the same time. Name your family members as early as the consultation, so that their documents and any power of attorney are planned for from the outset. If family reunification is only initiated after entry, the period of separation is often extended by months.

Avoid these mistakes

Common mistakes

The skilled worker submits the application themselves. Under § 81a Abs. 1 AufenthG, only the employer can apply for the fast-track procedure for skilled workers, under a power of attorney. An application submitted by the skilled worker is not treated as a § 81a procedure; the matter ends up in the regular process and the planned acceleration is lost entirely.

The power of attorney is missing or has not been signed. Without a valid power of attorney, the Ausländerbehörde must neither take action nor give the employer information. The application remains unprocessed, often without the employer noticing, because the authority must not tell them anything for data protection reasons – a loss of several weeks.

The start of work is set for “a few days after the Vorabzustimmung”. Anyone who schedules the start of the contract on the basis of this false assumption usually has to postpone it: even in the fast-track procedure for skilled workers, the German mission abroad alone has three weeks for the appointment and, as a rule, a further three weeks for the decision (§ 31a AufenthV). The consequences are unfilled positions, postponed projects and, in the worst case, an employment contract that falls through.

Only budgeting for the €411.00. The fee under § 47 Abs. 1 AufenthV covers only the carrying out of the procedure by the Ausländerbehörde. Anyone who does not factor in the fees of the recognition body and the visa fee of €75.00 will face unexpected bills in the middle of the procedure – and if payment is not made, the procedure is suspended.

The information in the employment contract and in the declaration on the employment relationship does not match. Differing information on pay, working hours or activity leads to queries from the Federal Employment Agency and can prevent approval. Every query costs weeks, because the deadlines only run once the documents are complete and free of contradictions.

Going straight to the German mission abroad without a Vorabzustimmung. Then the regular visa procedure applies: the German mission abroad has to obtain the involvement of the Ausländerbehörde during the ongoing procedure, which considerably prolongs processing. Waiting times for appointments and decisions vary considerably depending on the mission – applying for the Vorabzustimmung afterwards then hardly helps.

The appointment at the German mission abroad is not attended. If the appointment offered within three weeks is missed or cancelled, the accelerated allocation of appointments does not automatically apply again. The skilled worker has to join the regular queue for appointments, and the advantages of the entire fee-based procedure have practically gone up in smoke.

Frequently asked questions

Questions and answers

What does the Vorabzustimmung cost?

The Vorabzustimmung under § 31 Abs. 3 AufenthV does not trigger a separate fee – §§ 44 to 52 AufenthV provide no fee item for it. Only the fast-track procedure for skilled workers under § 81a AufenthG is subject to a fee: for this, the Ausländerbehörde charges €411.00 under § 47 Abs. 1 AufenthV, which is borne by the employer. In addition, there are the fees of the recognition body and the visa fee of €75.00.

How quickly is the visa issued after the Vorabzustimmung?

Not within a few days, as is often claimed. In the fast-track procedure for skilled workers, once the Vorabzustimmung has been presented and the appointment request has been received, the German mission abroad offers the skilled worker an appointment for submitting the visa application that falls within three weeks, and then, as a rule, decides within a further three weeks of the complete application being submitted (§ 31a AufenthV). Realistically, therefore, it takes around six weeks from the Vorabzustimmung; these deadlines do not apply to the simple Vorabzustimmung under § 31 Abs. 3 AufenthV.

How long does the entire fast-track procedure for skilled workers take?

The procedure is designed not to exceed a period of around four months. There is no overall statutory deadline for the Ausländerbehörde itself; § 81a Abs. 3 AufenthG requires it to send the employer the recognition body’s confirmations of receipt and of completeness without delay, to invite the employer within three working days as soon as the recognition body requests further proof or its findings are available, and to give its advance approval without delay once all requirements are met. How long the individual steps take depends on the recognition body, the Federal Employment Agency and the German mission abroad.

How long does the Ausländerbehörde take for the Vorabzustimmung?

For the Vorabzustimmung under § 31 AufenthV, there is no uniform nationwide processing deadline; the duration depends on the competent Ausländerbehörde and the completeness of the documents. The ten-day rule of § 31 Abs. 1 AufenthV does not help here either: it only concerns certain cases of the regular visa procedure after the German mission abroad has transmitted the application data, not the Vorabzustimmung. Ask your Ausländerbehörde directly about the actual processing time.

Who may apply for the fast-track procedure for skilled workers?

Under § 81a Abs. 1 AufenthG, employers can apply to the competent Ausländerbehörde for a fast-track procedure for skilled workers on behalf of the foreigner under a power of attorney. The skilled worker cannot submit the application themselves. Without a power of attorney in writing, the authority must neither take action nor give the employer any information.

When can a Vorabzustimmung under § 31 Abs. 3 AufenthV be considered?

§ 31 Abs. 3 AufenthV names, by way of example, the entitlement to the issue of the residence title, a public interest, the cases under §§ 18a, 18b, 18c Abs. 3, 19, 19b, 19c and 21 AufenthG, insofar as approval by the Ausländerbehörde is provided for in them, and urgent cases. Whether your case falls under this is decided by the competent Ausländerbehörde; this does not give rise to a legal entitlement to the Vorabzustimmung itself.

Is the Vorabzustimmung already a promise of the visa?

No. The Vorabzustimmung only anticipates the involvement of the Ausländerbehörde; the German mission abroad continues to examine identity, travel document and the general requirements for issue. If information is incorrect or documents are missing, the visa can be refused despite the Vorabzustimmung.

Is the approval of the Federal Employment Agency also required?

Yes, where the specific employment requires approval. The Ausländerbehörde obtains the approval of the Federal Employment Agency during the procedure; the employer provides the declaration on the employment relationship for this. If this form is missing or incomplete, the entire procedure is delayed.
