16 official procedures available

The Amtsgericht is the first instance of the ordinary courts in Germany. It has jurisdiction over civil matters up to a value in dispute of €10,000 (since 2026), family matters (divorce, parental custody), probate matters (Erbschein, the certificate of inheritance), land register matters (Grundbuch) and register matters (commercial register, register of associations), as well as custodianship proceedings.

Which Amtsgericht has jurisdiction depends on the court district — for probate matters, on the deceased's last habitual residence; for land register matters, on the location of the plot of land. The court costs are regulated uniformly nationwide in the Court Fees Act (Gerichtskostengesetz, GKG) and the Family Court Fees Act (Gesetz über Gerichtskosten in Familiensachen, FamGKG). On 1 June 2025, court fees were increased by the Act Amending Costs and Custodian Remuneration Law (Kosten- und Betreuervergütungsrechtsänderungsgesetz, KostBRÄG 2025): value-based fees by 6% and fixed fees by 9%. On the same day, register fees rose by around 50%.

Frequently asked questions

Questions about the Amtsgericht

How much does a Mahnbescheid cost?

From €38 (value in dispute up to €1,000). 100% online via online-mahnantrag.de. No lawyer required.

How much does an Erbschein (certificate of inheritance) cost?

The fee is 1.0 under Table B of the Court and Notary Costs Act (Gerichts- und Notarkostengesetz, GNotKG) and is charged twice — for the Erbschein and for the declaration in lieu of oath. For an estate of €50,000, that is around €330; for €200,000, around €870. With a notarial will, it is often not necessary.

How much does a divorce cost?

The costs depend on the value of the proceedings, which is calculated from three months' net income of both spouses, with a minimum of €3,000. At that level, the court fee is €251.00; the lawyer's costs come on top and usually exceed it.

How do I apply for a Grundbuchauszug?

At the Grundbuchamt (land registry) of the Amtsgericht: €10 uncertified, €20 certified. Possible online via grundbuch-portal.de.

How long do I have to disclaim an inheritance?

Only 6 weeks from the point you become aware of the inheritance. After that, the inheritance is deemed accepted — including any debts!
