11 official procedures available

The notary is an independent holder of a public office, appointed by the state. They notarially record legal transactions, certify signatures and advise all parties impartially. Notarial recording is required by law for many legal transactions: property purchases, marriage contracts, and the formation of a GmbH.

Notary fees are regulated uniformly nationwide in the GNotKG — negotiation is not possible. Since June 2025: an increase of 6–9%.

Questions about the notary

What does the notary cost when buying a house?

The notarial fee is not a percentage: under § 34 GNotKG it follows from the Geschäftswert (value of the subject matter) using Table B, and it is degressive. For a purchase price of €300,000, the notarial recording costs €1,270 (2.0 fee); with the completion and supervision fees (0.5 each) it comes to around €1,905, or roughly 0.63%. The fees of the Grundbuchamt and the real estate transfer tax (Grunderwerbsteuer) are added separately. The often-quoted 1 to 1.5% describe this total, not the notary's fee. The amount is in any case uniform nationwide: under § 17 BNotO, the notary is required to charge the statutory fees.

What does a will cost at the notary?

Depends on your assets: approx. €165 at €50,000, approx. €935 at €500,000. Plus €75 for deposit at the Amtsgericht (local court).

Do I need a lasting power of attorney?

Strongly recommended! Without a power of attorney, no one can decide for you — not even your spouse. Cost: from €60 (certification).

What does forming a GmbH cost?

GmbH: approx. €600–€800 notary fees + €150 Handelsregister. UG (Musterprotokoll): from approx. €300.

Can I choose the notary freely?

Yes. The costs are identical nationwide (GNotKG). However, every notary may only notarise within their own Amtsbezirk.
