Objection to the contribution notice

A one-month deadline — and a simple email is not enough

In writingDeadline 1 month

You can lodge an objection (Widerspruch) against a Festsetzungsbescheid (assessment notice). Under § 70 Abs. 1 Satz 1 VwGO, the deadline is one month from notification of the notice – not from the date on which you opened it, and not from the payment reminder.

Most objections fail on form before the substance is even considered. Permitted are the written objection and the objection on the record; a simple email is not enough, and an objection by telephone is not possible either. Anyone who tries to meet the deadline with an email has missed it – and a late objection also makes a later legal action inadmissible.

The second point surprises many people, and it follows from a rule with an exception. § 80 Abs. 1 VwGO first provides: “An objection and a rescissory action have suspensive effect.” But Abs. 2 Nr. 1 expressly excludes from this the cases concerning the “demand for public levies and costs” – and the Rundfunkbeitrag is such a levy. So you must keep paying while the objection is pending.

One distinction up front, because almost every description blurs it: the Beitragsservice of ARD, ZDF and Deutschlandradio administers – it sends out letters, collects payments and answers enquiries. Under § 10 Abs. 7 RBStV, it is a “non-incorporated public-law administrative association” and therefore has no legal personality of its own. The decision is taken elsewhere: § 10 Abs. 5 RBStV provides that outstanding contributions “are assessed by the competent Landesrundfunkanstalt” – that is, by the WDR, BR, NDR, MDR, SWR and the others. In practice, this means: a notice comes from your Landesrundfunkanstalt, and it is against that body that an objection and a legal action are directed, not against the Beitragsservice.

What you need

The contested notice

With date and file reference – both belong in the objection so that it can be matched to your file. The notice also states the Rechtsbehelfsbelehrung (instructions on legal remedies) with the competent body and address; read it, it is more authoritative than any general information.

Your contribution number

It appears on every letter. Without it, matching the file is difficult, and in the meantime, payment reminders and, where applicable, enforcement continue – the objection does not stop either of them.

Your evidence for your argument

It depends on what you are relying on: proof of payment, if payment has already been made; the Befreiungsbescheid (exemption notice), if an exemption had been granted; the Abmeldebestätigung (confirmation of deregistration), if you were no longer required to register for the period in question. An objection without evidence is just an assertion.

Proof of dispatch

A registered letter (Einschreiben) or a documented electronic transmission. Because the one-month deadline is a cut-off period, you bear the risk of receipt – and without proof, timely arrival cannot be demonstrated later.

If you missed the deadline: the reasons

If missing the deadline was not your fault – for example because of a hospital stay – a restoration of the status quo ante (reinstatement after a missed deadline) may be possible. Enclose the reasons and evidence, and act immediately once the obstacle has ceased to apply.

Step by step

How to proceed

  1. 1

First establish the date of notification

The one-month deadline under § 70 VwGO runs from notification, not from when you actually read it. Anyone who was on holiday loses days. First find the date on the notice and calculate the deadline before you think about the substance – questions of form and deadline decide more often than questions of substance.

  2. 2

Lodge it in writing — not by simple email

Permitted are the written objection and the objection on the record at the authority. A simple email is not legally effective, and neither is a phone call. Anyone who wants to be safe sends a registered letter (Einschreiben) – proof of receipt is worth more than the postage saved, given a cut-off period.

  3. 3

Address it to the body named in the notice

Formally, it is directed against the Landesrundfunkanstalt that issued the notice under § 10 Abs. 5 RBStV; it is also accepted by the Beitragsservice. What matters is the address given in the Rechtsbehelfsbelehrung of your notice.

  4. 4

Keep paying — the objection does not stop anything

Because of § 80 Abs. 2 Nr. 1 VwGO, suspensive effect does not apply to public levies. So do not stop paying: otherwise the arrears grow, a late-payment penalty is charged, and enforcement can begin, even while you might still be proven right.

  5. 5

State and prove your argument in concrete terms

The most promising arguments are above all: you were not liable to pay the contribution in the period in question; an exemption or reduction had already been granted; the contribution had already been paid (with evidence); an exemption application was refused despite the evidence provided. Hopeless, by contrast, are arguments against the programming or against the constitutionality of the contribution as such.

  6. 6

In Bavaria: check whether you want to go straight to legal action

Anyone who receives a notice from the Bayerischer Rundfunk can choose between the objection and direct legal action before the Verwaltungsgericht (administrative court). This is a peculiarity of that federal state's law and is not the case in other federal states – read the Rechtsbehelfsbelehrung carefully, it tells you which route is open to you.

  7. 7

After the Widerspruchsbescheid, observe the deadline for legal action

If the objection is rejected, a further deadline of one month runs for the rescissory action before the Verwaltungsgericht, from service of the Widerspruchsbescheid (ruling on the objection). The same applies here: because of § 80 Abs. 2 Nr. 1, the legal action does not have suspensive effect.

Costs and payment

What the objection costs — and what a case really costsWhy no flat figure for court costs appears here
Objection (Widerspruch)Free of charge

Deadline: objectionOne month after notification
Deadline: legal actionOne month from the Widerspruchsbescheid
Suspensive effectNone — keep paying
Value in dispute before the courtThe amount in dispute
On a low incomeLegal aid (Prozesskostenhilfe) possible

The objection itself is free of charge; at most postage is incurred, and a registered letter (Einschreiben) is worth the expense, because you bear the risk of receipt under a cut-off period. On court costs, you will deliberately find no flat figure here, even though amounts such as “from €360” circulate online – these are misleading and discourage people from exercising a right. The reason is set out in § 52 Abs. 3 GKG: “If the plaintiff's application concerns a specified monetary payment or an administrative act relating to it, its amount is decisive.” The value in dispute is therefore the amount in dispute – for a notice concerning a few hundred euros, it is correspondingly low, and the court fees, which are calculated from the GKG's fee table, come out considerably lower than any flat figure quoted. What a specific case costs therefore depends on your notice; if in doubt, ask the Rechtsantragstelle (legal application office) of the Verwaltungsgericht, which gives information on this free of charge. On a low income, Prozesskostenhilfe (legal aid) may be available, and for advice outside court, Beratungshilfe (advisory assistance). More important than the question of costs is, in any case, the question of payment: because of § 80 Abs. 2 Nr. 1 VwGO, an objection and a legal action have no suspensive effect, because it concerns a public levy. So keep paying – if you are proven right, it is refunded; if you stop paying, a late-payment penalty and enforcement are added, even if you ultimately prevail.

Good to know

Important notes

One month from notification, not from when you read it and not from the payment reminder (§ 70 VwGO).

A simple email is not legally effective, and neither is a phone call. In writing or on the record.

The objection does not stop anything. § 80 Abs. 2 Nr. 1 VwGO excludes public levies from suspensive effect.

Keep paying. If you succeed, it is refunded; if you stop paying, a late-payment penalty and enforcement are added.

A late objection makes the later legal action inadmissible. The deadline is the single most important point on this whole page.

Prove your argument. Proof of payment, Befreiungsbescheid (exemption notice) or Abmeldebestätigung (confirmation of deregistration) – without evidence it is just an assertion.

In Bavaria you can go straight to legal action instead of first lodging an objection. The Rechtsbehelfsbelehrung tells you.

Arguments against the programming or the constitutionality get you nowhere. They have been settled by the courts.

Avoid these mistakes

Common mistakes

Lodging an objection by email. Not legally effective – and if the deadline expires in the meantime, the legal action is also inadmissible.

Calculating the deadline from the payment reminder. It runs from notification of the notice, often weeks earlier.

Stopping payment during the objection. There is no suspensive effect; the arrears grow.

Objecting without evidence. “I paid” without proof of payment leads to rejection.

Arguing with the programming or the constitutionality. These arguments have been decided and do not succeed.

Sending without proof of receipt. Under a cut-off period, you bear the risk that receipt cannot be proven.

Giving up because of supposedly high court costs. The value in dispute is the amount in dispute, and legal aid (Prozesskostenhilfe) is available.

Frequently asked questions

Questions and answers

How long do I have to lodge the objection?

One month from notification of the notice – so provides § 70 Abs. 1 Satz 1 VwGO. Two misunderstandings regularly cost people this legal remedy: the deadline does not run from the day on which you opened the letter, and not from a later payment reminder – what matters is notification of the notice itself. Anyone who was travelling loses those days. The consequence of missing it is harsh: a late objection is rejected as inadmissible, and that also makes a later legal action inadmissible – the substance of the matter is then no longer decided. If missing the deadline was not your fault, for example because of a hospital stay, a restoration of the status quo ante may be possible; in that case, act immediately and enclose evidence.

Can I send the objection by email?

No – and this is the most common formal error. The official information is unambiguous: “Lodging a legally effective objection by simple email is not possible. An objection by telephone is likewise inadmissible.” Permitted are the written objection and the objection on the record at the authority; a De-Mail with a qualified signature is also accepted. In practice, this means: a letter, ideally as a registered letter (Einschreiben). The postage is money well spent, because under a cut-off period you bear the risk of receipt – without proof, it cannot be shown later that, and when, your objection arrived. Anyone who tries to meet the deadline with an email has, as a rule, missed it.

Must I keep paying while the objection is pending?

Yes, and the reasoning is worth knowing, because it shows both the rule and the exception. § 80 Abs. 1 VwGO first sets out the principle: “An objection and a rescissory action have suspensive effect.” But Abs. 2 Nr. 1 excludes from this the “demand for public levies and costs” – and the Rundfunkbeitrag is such a levy. For you, that means: the objection neither defers the due date nor halts enforcement. Anyone who stops paying accumulates arrears, on which a late-payment penalty of 1% (at least €8.00) is charged after four weeks, and risks attachment of their bank account – even if they are ultimately proven right. So keep paying: if you succeed, everything is refunded.

Which arguments give me a chance of success?

With factual, provable arguments against your notice. Four in particular are promising: you were not liable to pay the contribution in the period in question – for example because the home had been deregistered or another person was paying for it; an exemption or reduction had already been granted; the contribution had already been paid, which you show with proof of payment; or an exemption application was refused despite the evidence provided. In each case, the evidence is decisive – without it, it remains an assertion. Hopeless, by contrast, are arguments directed against the contribution as such: criticism of the programming, lack of use, no receiving device, or constitutionality. The latter has been settled by the highest courts, and the contribution being independent of any device is precisely what is intended.

What does it cost if I go to court?

Less than the flat figures circulating online suggest – which is why none is given here. § 52 Abs. 3 GKG provides: “If the plaintiff's application concerns a specified monetary payment or an administrative act relating to it, its amount is decisive.” The value in dispute is therefore the amount in dispute under your notice, and not a flat default value – for a notice concerning a few hundred euros, the court fees turn out correspondingly low. The exact figure depends on your case; the Rechtsantragstelle (legal application office) of the Verwaltungsgericht gives information on this free of charge. On a low income, Prozesskostenhilfe (legal aid) may be available, and Beratungshilfe (advisory assistance) for advice beforehand. Do not let exaggerated cost figures stop you from pursuing a justified argument.

To whom do I address the objection?

To the body named in the Rechtsbehelfsbelehrung of your notice – which is more authoritative than any general information. Legally, the objection is directed against the Landesrundfunkanstalt that issued the notice: under § 10 Abs. 5 RBStV, outstanding contributions “are assessed by the competent Landesrundfunkanstalt”, that is, by the WDR, BR, NDR, SWR, MDR and the others. The Beitragsservice accepts the objection, but under § 10 Abs. 7 RBStV it is only a “non-incorporated public-law administrative association” with no legal personality of its own – no legal action is brought against it. In every case, state your contribution number, the date of the notice and the file reference, so that your letter can be matched to your file.

Is it true that I can go straight to legal action in Bavaria?

Yes, that is a peculiarity which does not exist everywhere in this form. Anyone who receives a notice from the Bayerischer Rundfunk can choose: either to lodge an objection or to bring legal action before the Verwaltungsgericht directly. In the other federal states, the objection is, as a rule, the preliminary and necessary step. Do not rely on this general description, however, but on the Rechtsbehelfsbelehrung of your own notice – it states the permissible legal remedy, the deadline and the body. For the choice itself: the objection is free of charge and can lead to the matter being remedied without a court being involved; direct legal action skips a step, but costs court fees. In both cases, the obligation to pay continues.

What happens if the objection is rejected?

In that case, you receive a Widerspruchsbescheid (ruling on the objection), and from its service a further deadline of one month runs for the rescissory action before the Verwaltungsgericht. This legal action, too, has no suspensive effect because of § 80 Abs. 2 Nr. 1 VwGO – the contribution remains due, and enforcement can proceed in parallel. If you want to prevent that, an additional application for an order of suspensive effect under § 80 Abs. 5 VwGO would be needed; whether it has any prospect depends on the individual case and should be assessed by a professional. Before bringing the action, consider soberly whether your argument is factual in nature and provable – bringing an action against the contribution as such is hopeless and causes only costs.
