Objection to the care grade (Pflegegrad)

Pflegekasse · Deadline, assessment report and statement of reasons

In writingDeadline: 1 month

Against an official notice (Bescheid) from the long-term care insurance fund (Pflegekasse) – a refusal or too low a grade – you can lodge an objection (Widerspruch). It is free of charge, you do not need a lawyer, and the deadline is one month from notification of the notice.

The most important practical advice concerns the order of steps. You can lodge the objection without a statement of reasons, to meet the deadline – one sentence is enough – and submit the reasons later. This secures the deadline, and you gain the time you need for what is actually the first step.

This first step is the copy of the assessment report. Without it, you are objecting to a result whose origin you do not know. With it, you can see how many points were awarded in each of the six modules – and that is where the statement of reasons should focus, wherever the rating does not match your everyday life.

In all honesty: how an objection turns out depends entirely on the individual case. Blanket success rates that circulate online say nothing about your case. What actually improves the prospects is a statement of reasons based, module by module, on concrete observations.

What you need

The letter of objection (Widerspruch)

One sentence is enough to meet the deadline: “I am lodging an objection to the notice dated … I will submit a statement of reasons later.” Add your name, insurance number and reference number. Send it in a way that lets you prove receipt.

The notice with Rechtsbehelfsbelehrung (instructions on legal remedies)

Read the Rechtsbehelfsbelehrung on the day of service: it states the deadline, the form and the addressee. If it is missing or incorrect, the deadline is extended considerably – which is a reason to look at the notice closely rather than put it aside.

The copy of the assessment report

Request it expressly from the Pflegekasse; you are entitled to it. Without it, a targeted statement of reasons is not possible – request it on the same day you read the notice, because it takes time to arrive.

An up-to-date care diary

Over one to two weeks, with dates. It is the counterpart to the assessor’s snapshot and works particularly well where the need for care fluctuates or arises at night.

New or overlooked medical findings

Doctors' letters, discharge reports, statements from the care service or therapists – especially ones the assessor did not have. A statement from the treating doctor on a single module often carries more weight than a stack of general medical findings.

Step by step

How to proceed

  1. 1

Lodge an objection immediately to meet the deadline

One sentence is enough, and you submit the statement of reasons afterwards. This secures the one-month deadline while you request and evaluate the assessment report. Do not wait until you have “something presentable” – that is the most common reason deadlines are missed.

  2. 2

Request the copy of the assessment report the same day

In writing, from the Pflegekasse. Sending it takes time, and without the assessment report you cannot give reasons. Combining both in one letter – the objection plus the request – is the most efficient way.

  3. 3

Go through the assessment report module by module

Six areas are assessed: mobility, cognitive and communicative abilities, behaviour and psychological issues, self-care, coping with illness- and therapy-related requirements, and organising daily life. Mark every rating that does not match your everyday life.

  4. 4

State reasons specifically, not in general terms

Not “I am worse off”, but: “The self-care module notes ‘washing: largely independent’. In fact, my daughter has to help me every day with washing my back, blow-drying my hair and putting on my compression stockings; the care diary from 3 to 16 August confirms this.” One point per module, with evidence.

  5. 5

    Enclose new evidence

An up-to-date care diary, new medical findings, a statement from the care service or the GP on a specific module. What is most effective is what the assessor did not have.

  6. 6

    Attend the second assessment

As a rule, the Pflegekasse orders a new assessment, often by a different person. Prepare as you did the first time, arrange to have someone with you – and describe the bad day again, not the best one.

  7. 7

If the Widerspruchsbescheid (ruling on the objection) goes against you: the Sozialgericht

Legal action at the Sozialgericht (social court) is possible against the Widerspruchsbescheid; the procedure is free of court costs for insured persons. The deadline and addressee are stated in the Rechtsbehelfsbelehrung of the Widerspruchsbescheid. Get advice beforehand – social associations and the independent patient advice service help free of charge.

Costs and payment

What the objection costsAnd when applying for a higher care grade is the better route
Objection (Widerspruch)Free of charge
Copy of the assessment reportFree of charge, on request
DeadlineOne month after notification
Meeting the deadline without a statement of reasonsPossible
Legal action before the social courtFree of court costs for insured persons
Legal aid, personal contribution€15.00

The objection costs nothing, nor does the copy of the assessment report, and a lawyer is not required. If you want legal assistance and your income is low, Beratungshilfe (advisory assistance for people on low incomes) is an option, with a personal contribution of €15.00 that can be waived in individual cases; social associations and the independent patient advice service also give free advice. Legal action at the Sozialgericht is free of court costs for insured persons. More important than the costs is which path to take: objection or an application for a higher care grade? The objection is the right route if you believe the condition at the time of the assessment was wrongly evaluated – if successful, it then applies back to the original application. An application for a higher care grade is the right route if the condition has worsened since the assessment; it applies from the new application onward, but has no waiting period and can be submitted at any time. Anyone unsure can lodge an objection within the one-month deadline to keep the option open and clarify the question in the statement of reasons – not the other way round, because an expired objection deadline cannot be made up for. Finally, on success rates: figures circulating online say nothing about your case. What counts is a statement of reasons based, module by module, on concrete, evidenced observations.

Good to know

Important notes

One month from notification. Read the Rechtsbehelfsbelehrung on the day of service – it states the deadline, the form and the addressee.

Lodge an objection to meet the deadline and state reasons later. One sentence is enough. The deadline is secured by this.

Request the copy of the assessment report immediately. Without it, you are objecting to a result whose origin you do not know.

Give reasons module by module. “I am worse off” cannot be checked; a specific task with a date can.

An objection and an application for a higher care grade are two different routes. One corrects the old rating, the other records a new deterioration.

There is no waiting period for an application for a higher care grade. It can be submitted at any time, even shortly after a notice.

The figures circulating on success rates are meaningless. What counts is the quality of the statement of reasons in the individual case.

Free help is available. Social associations, the independent patient advice service and, for people on low incomes, Beratungshilfe for €15.00.

Avoid these mistakes

Common mistakes

Waiting until the statement of reasons is finished. The one-month deadline runs regardless – and an expired deadline cannot be made up for.

Giving reasons without the assessment report. Then you are arguing past the actual rating.

Writing in general terms instead of specifically. Only what can be pinned to a module, a task and a date is checkable.

Putting on a brave face again at the second assessment. The same mistake as the first time, with the same result.

Confusing an objection with an application for a higher care grade. Anyone who pursues a deterioration as an objection is arguing about the wrong point in time.

Not reading the Rechtsbehelfsbelehrung. It contains the deadline, the form and the addressee – and if it is missing or wrong, this changes your deadline considerably.

Frequently asked questions

Questions and answers

How much time do I have?

One month from notification of the notice. The exact deadline, the form and the addressee are stated in the Rechtsbehelfsbelehrung of the notice – read it on the day of service, not later. If the instructions are incorrect or missing altogether, the deadline is extended considerably; that is a reason to look at the notice closely. If necessary, secure the deadline with a single sentence and submit the statement of reasons later: this is permitted, and it is the most common way people avoid missing the deadline.

Do I have to give reasons for the objection immediately?

No. It is enough to lodge the objection to meet the deadline – “I am lodging an objection to the notice dated … I will submit a statement of reasons later.” – and to submit the statement of reasons afterwards. You should do exactly that, because the actual first substantive step takes time: requesting and evaluating the copy of the assessment report. Combine both in one letter. Set yourself a deadline for the statement of reasons and ask the fund by when it expects it – that way the matter stays moving.

Why is the assessment report so important?

Because the notice only states the result, not how it was reached. The assessment report shows how each of the six modules was evaluated – mobility, cognitive and communicative abilities, behaviour and psychological issues, self-care, coping with illness- and therapy-related requirements, organising daily life and social contact. Only then can you say where the rating does not match your everyday life. You are entitled to the copy, it costs nothing, and you should always request it – even after an approval, because it is the basis for any later application for a higher care grade.

How do I state reasons effectively?

Module by module, with evidence. Take every rating that is wrong and set a concrete observation against it – with activity, frequency and date. So instead of “I am worse off”: “The self-care module notes ‘washing: largely independent’. In fact, daily help is needed with washing the back, blow-drying hair and putting on compression stockings; see the care diary from 3 to 16 August.” Enclose what the assessor did not have: new medical findings, a statement from the care service or the GP on a single module. Less but concrete carries more weight than a thick stack.

Objection or application for a higher care grade — which is right?

That depends on the timing. The objection contends that the condition at the time of the assessment was wrongly evaluated; if successful, the higher grade applies back to the original application. An application for a higher care grade is a new application and the right route if the condition has worsened since the assessment – for example after a fall or a hospital stay; it applies from the month of the new application. There is no waiting period for an application for a higher care grade. If in doubt, secure the objection deadline first, since that one runs out; an application for a higher care grade is still possible at any time.

Do I need a lawyer?

No. The objection proceedings are free of charge and designed for insured persons to conduct them themselves. Free support is offered by social associations, where membership usually costs a few euros a month and includes representation, as well as the independent patient advice service and the local care support centres (Pflegestützpunkt). If you want legal assistance and have little income, there is Beratungshilfe: the personal contribution is €15.00 and can be waived in individual cases; the Amtsgericht (local court) issues the certificate of entitlement. For a later legal action at the Sozialgericht, insured persons do not pay court costs.

What are my chances?

This cannot reliably be put in a single figure, and the percentages that circulate relate to different populations and say nothing about your case. What actually influences the prospects can be named concretely: whether you have evaluated the assessment report, whether your statement of reasons relates to individual modules, whether you bring new evidence that the assessor did not have, and whether someone who knows your everyday life is present at the second assessment. An objection without these four things has a hard time; one with them is a serious matter.

What happens after the objection?

The Pflegekasse reviews it again and, as a rule, arranges a second assessment, often by a different assessor. Prepare for this just as you did the first time. A Widerspruchsbescheid is then issued. If it is in your favour, the new grade applies back to the original application. If it rejects the objection, you can take legal action at the Sozialgericht – free of court costs for insured persons, with the deadline and addressee stated in the Rechtsbehelfsbelehrung. There is no fixed processing time for the objection proceedings; ask about the status if nothing happens for a long time.
