Residence permit for self-employed persons

Ausländerbehörde · Residence law

In person

The residence permit (Aufenthaltserlaubnis) under § 21 of the Residence Act (Aufenthaltsgesetz, AufenthG) allows third-country nationals to pursue a self-employed commercial or freelance activity in Germany. Under § 21 Abs. 1 Satz 1 AufenthG, three requirements must be met at the same time: there must be an economic interest or a regional need, the activity must be expected to have positive effects on the economy, and the financing of its implementation must be secured by equity or by a loan commitment.

The fee for issuing the permit is €100.00 nationwide under § 45 of the Ordinance Governing Residence (Aufenthaltsverordnung, AufenthV) – the Ordinance Governing Residence does not provide for a higher fee rate for self-employed persons. Under § 21 Abs. 4 AufenthG, the title is limited to a maximum of three years. Anyone older than 45 is granted the permit under § 21 Abs. 3 AufenthG only if adequate retirement provision is proven. Graduates of German universities as well as researchers and scientists can use the simplified route of § 21 Abs. 2a AufenthG.

Required documents

What you need to bring

Valid national passport

The passport must be valid on submission of the application and should, if possible, cover the period of validity applied for, because a residence title is never issued beyond the validity of the passport. Bring the original and copies of all used pages with visas and entry and exit stamps. If your passport is due to expire soon, have it renewed in advance by your country’s diplomatic mission – otherwise you will only receive a correspondingly short title and will have to pay the extension fee again sooner.

Completed application form

Each Ausländerbehörde (foreigners authority) uses its own form “Antrag auf Erteilung eines Aufenthaltstitels” (application for the issue of a residence title), which you download from the service portal of your city or district (Landkreis). Fill it in completely and truthfully: false information about the intended economic activity can later lead to the withdrawal of the title. Many authorities only take your signature on site, because it is recorded together with the fingerprints for the electronic residence title.

Current biometric photograph

You need a photograph suitable for biometric use, taken from the front, with a neutral facial expression and an evenly lit background. The photograph should be recent and match your current appearance, otherwise it will be rejected when it is recorded. Since 1 May 2025, the Ausländerbehörde only accepts it in digital form – taken at the terminal in the office, where one is available, or transmitted in encrypted form by a certified photographer; the transitional period for paper photographs ended on 31 July 2025.

Business plan

The business plan is the core of the application. It should contain the business idea, a market and competition analysis, the choice of location, cost calculation and turnover and liquidity planning for at least three years, supplemented by staff and investment planning. On the basis of this document, the authority assesses the criteria of § 21 Abs. 1 Satz 2 AufenthG: the viability of the business idea, entrepreneurial experience, the amount of capital invested, the effects on the employment and training situation and the contribution to innovation and research. The Chambers of Industry and Commerce (Industrie- und Handelskammer, IHK), the Handwerkskammer (chamber of skilled crafts, HWK) offices and local start-up centres offer an initial consultation free of charge.

Proof of financing

§ 21 Abs. 1 Satz 1 AufenthG expressly requires that the financing of the implementation is secured by equity or by a loan commitment. Current bank statements, a blocked account (Sperrkonto), a binding loan commitment from your bank, guarantees or signed investor agreements serve as proof. Non-binding letters of intent are generally not sufficient – the authority checks whether the funds can actually be drawn on and match the capital requirements of your business plan.

Proof of health insurance

Self-employed persons are not automatically subject to compulsory insurance, so you must prove private health insurance or voluntary statutory health insurance that covers your entire stay. The certificate is issued by your health insurance fund (Krankenkasse) or your insurer; it should show the scope of benefits and the start of the insurance cover. Travel health insurance alone is generally not sufficient for a residence title.

Proof of retirement provision (from age 45)

Under § 21 Abs. 3 AufenthG, foreigners who are older than 45 should only be granted the residence permit if they have adequate retirement provision. Pension entitlements, private pension insurance, life insurance policies, real estate or capital assets can serve as evidence. Enclose these documents without being asked if you belong to this age group – missing proof is one of the most common reasons for refusal and, once the decision has been made, can only be submitted later in objection (Widerspruch) or court proceedings.

Trade registration or proof of freelance status

Those carrying on a trade submit the trade registration (Gewerbeanmeldung) under § 14 of the Trade Regulation Code (Gewerbeordnung, GewO), which they receive from the Gewerbeamt (trade office) or Ordnungsamt (public order office) of their municipality. Under § 6 GewO, freelancers within the meaning of § 18 Abs. 1 Nr. 1 of the Income Tax Act (Einkommensteuergesetz, EStG) do not register a trade; instead, they submit the tax registration questionnaire (Fragebogen zur steuerlichen Erfassung) or the tax number (Steuernummer) assigned by the Finanzamt (tax office). Clarify the classification early – it determines liability for trade tax, chamber membership and the other proof required.

Licence to practise for liberal professions

For freelance activity, § 21 Abs. 5 AufenthG requires that any licence needed to practise the profession has been granted or that its grant has been promised. This mainly concerns regulated professions: doctors need the licence to practise medicine (Approbation), lawyers admission to the bar (Kammerzulassung), architects entry in the register of architects (Architektenliste). The competent bodies are the licensing or recognition authority of the federal state (Bundesland) or the relevant professional chamber, not the Ausländerbehörde.

CV and proof of qualifications

Your tabular CV must show your entrepreneurial and professional experience, because § 21 Abs. 1 Satz 2 AufenthG expressly lists it among the assessment criteria. Enclose certificates, proof of previous companies, references and confirmed orders. If you rely on § 21 Abs. 2a AufenthG, also submit the degree certificate from the German university or proof of your research activity; foreign qualifications should be translated and, where possible, classified via the anabin database or the Central Office for Foreign Education (Zentralstelle für ausländisches Bildungswesen, ZAB).

Meldebescheinigung and tenancy agreement

The Ausländerbehörde is only competent for persons registered in its area; you prove your place of residence with the registration certificate (Meldebescheinigung) from the Bürgeramt (citizens’ office) and the tenancy or purchase agreement. Under § 17 of the Federal Act on Registration (Bundesmeldegesetz, BMG), the Anmeldung (residence registration) must take place within two weeks of moving in; you also need the Wohnungsgeberbestätigung (landlord’s confirmation) from your landlord. Without a registered address, the application cannot be processed.

Business figures for the extension and the settlement permit

For an extension, and all the more for the settlement permit (Niederlassungserlaubnis) under § 21 Abs. 4 AufenthG, the authority requires evidence of the actual success of the activity: tax assessment notices, business evaluation reports (betriebswirtschaftliche Auswertungen), annual financial statements, provisional VAT returns and proof of jobs created. In addition, you must prove that your subsistence and that of your family members living with you as a family unit is secured. Set up your bookkeeping from the start so that these documents are available at short notice at any time.

Step by step

How to proceed

  1. 1

Align your business idea with § 21 AufenthG

Before you invest time and money, check whether your project meets all three requirements of § 21 Abs. 1 Satz 1 AufenthG at the same time: an economic interest or a regional need, positive effects on the economy and financing secured by equity or a loan commitment. A regional need can exist, for example, if you close a gap in supply in a structurally weak region or offer a service that is in demand. If the answer to one of these questions is negative, it is better to revise the concept now than after a refusal.

  2. 2

Build your business plan and financing

Draw up a complete business plan with market, turnover and liquidity planning for at least three years and disclose your capital requirements. At the same time, secure the financing: equity in a German or foreign account, a binding loan commitment, guarantees or signed investor agreements. Start-up advice free of charge from the Industrie- und Handelskammer, the Handwerkskammer or a local start-up centre is particularly worthwhile here, because the same bodies are later involved in the procedure.

  3. 3

Check the simplified route under § 21 Abs. 2a AufenthG

Graduates of German universities as well as researchers and scientists should receive the residence permit by way of derogation from Abs. 1 if the intended self-employed activity shows a connection with the knowledge acquired during their studies or with their previous research activity. For this group, the extensive examination of the economic interest and of the secured financing therefore does not apply. Expressly refer to § 21 Abs. 2a AufenthG in your application and prove the professional connection with your degree certificate, research contract or list of publications.

  4. 4

Apply for a national visa at the German mission abroad

If you are still abroad, you need a national visa (category D visa) for self-employment before entering Germany, which you apply for at the German embassy or consulate general competent for your place of residence. The German mission abroad usually involves the Ausländerbehörde at your future place of residence, which is why your business plan and proof of financing should already be complete. The fee for the national visa is €75.00 under § 46 AufenthV. Do not enter on a Schengen visa for visiting purposes with the plan of switching afterwards – this only succeeds in narrow exceptional cases.

  5. 5

Enter Germany and register your address

After entering Germany, register your address at the Bürgeramt of your municipality within two weeks under § 17 BMG; bring your passport and the Wohnungsgeberbestätigung. The Meldebescheinigung establishes the local jurisdiction of the Ausländerbehörde and is needed for almost every further step, from the business account to the trade registration. On this occasion, apply for several copies of the Meldebescheinigung straight away.

  6. 6

Register a trade or notify freelance activity

Those carrying on a trade register it with the Gewerbeamt or Ordnungsamt under § 14 GewO; the fee is set by the local authority and is typically between about €15 and €65 nationwide. Under § 6 GewO, freelancers do not register a trade, but notify the Finanzamt of their activity directly via the Fragebogen zur steuerlichen Erfassung. Regulated liberal professions also need the licence to practise under § 21 Abs. 5 AufenthG, such as the Approbation or chamber admission.

  7. 7

Book an appointment and submit the application

Book an appointment at the Ausländerbehörde competent for your place of residence – in larger cities, the waiting times for an appointment are considerable, which is why you should reserve one before entering Germany if possible. On site, you submit the application form with all documents; fingerprints, signature and photograph for the electronic residence title are recorded. If your visa expires before the decision, submit the application in good time before it expires: an application made in good time triggers the legal fiction of continued validity (Fortgeltungsfiktion) under § 81 Abs. 4 AufenthG, so that your previous residence title is deemed to continue to exist until the decision.

  8. 8

Wait for the involvement of the expert bodies

Under § 21 Abs. 1 Satz 3 AufenthG, the Ausländerbehörde involves in its assessment the expert bodies for the location of the planned activity, the competent trade authorities, the professional representative bodies under public law and the authorities competent for admission to the profession. Depending on the project, these are the Industrie- und Handelskammer, the Handwerkskammer, a professional chamber or a specialist supervisory authority. These bodies give a professional assessment – the decision itself is taken by the Ausländerbehörde. Expect questions about individual items in your business plan during this phase and answer promptly, because otherwise the deadline quietly keeps running.

  9. 9

Pay the fee and collect your residence title

Issuing the residence permit costs €100.00 nationwide under § 45 AufenthV; payment is usually made on submission of the application or on collection, by EC card or in cash. The electronic residence title is produced centrally as a chip card; production takes a few weeks, and you collect it in person from the Ausländerbehörde. When you receive it, check the ancillary provision (Nebenbestimmung) entered on it straight away – it must expressly permit self-employed activity, otherwise you must not take up the activity.

  10. 10

Apply for an extension or a settlement permit

Under § 21 Abs. 4 AufenthG, the title is limited to a maximum of three years; this time limit does not apply to freelancers under Abs. 5. An extension of more than three months costs €93.00, an extension of up to three months €96.00. After three years, by way of derogation from § 9 Abs. 2 AufenthG, you can apply for the settlement permit if you have been self-employed for three years, your activity, in particular on account of its success and its duration, gives reason to expect a further sustainable development of the business, the subsistence of you and your family members is secured by sufficient income and no reasons of public security or order stand in the way (§ 9 Abs. 2 Satz 1 Nr. 4 AufenthG); the fee is €124.00 under § 44 Nr. 2 AufenthV.

There is no surcharge for self-employed persons. The fees under the Ordinance Governing Residence are uniform nationwide and binding on all Ausländerbehörde offices – there is no local range here. The Ordinance Governing Residence does not provide for a higher fee rate for the residence permit under § 21 AufenthG: the same rate of €100.00 applies as for other residence permits. If a body demands significantly higher amounts, ask it to state the specific fee number.

The only higher rate concerns the settlement permit. If you are granted the settlement permit under § 21 Abs. 4 AufenthG after three years of successful self-employment, the fee is €124.00 under § 44 Nr. 2 AufenthV. This amount is also the same nationwide and is well below the €200 figure that often circulates on the internet.

Factor in the additional costs. In addition to the fee for the title, there are typically costs for the trade registration (set by the local authority, usually between about €15 and €65 nationwide – Hamburg around €20, Berlin around €26, Munich around €50), for certified translations, for the Statement of Comparability (Zeugnisbewertung) and, where applicable, for advice from a tax consultant or lawyer. These amounts are not set by the Ausländerbehörde; they depend on the competent body in each case and on the scope.

Good to know

Important notes

From age 45, retirement provision counts. § 21 Abs. 3 AufenthG provides that foreigners who are older than 45 should only be granted the residence permit if they have adequate retirement provision. This requirement is often overlooked, but for founders in this age group it is the decisive hurdle. Collect proof of pension entitlements, private pension contracts, life insurance or assets early and enclose it with your application on your own initiative.

The title is valid for a maximum of three years. Under § 21 Abs. 4 Satz 1 AufenthG, the residence permit is limited to a maximum of three years – a shorter period of validity is permitted and common in practice, for example if the authority first wants to observe how the business develops. The time limit is not a disadvantage but the norm: you then extend the title for €93.00 or switch to the settlement permit after three years.

University graduates and researchers have a simplified route. Under § 21 Abs. 2a AufenthG, graduates of German universities as well as researchers and scientists should receive the residence permit by way of derogation from Abs. 1 if the intended self-employed activity shows a connection with the knowledge they have acquired or with their previous activity. The examination of the economic interest and of the secured financing under Abs. 1 then does not apply. Expressly cite this provision in your application – otherwise it is easily overlooked.

Freelancers: no trade, but a licence to practise. Members of the liberal professions – such as doctors, lawyers, artists or engineers – do not register a trade under § 6 GewO, but notify the Finanzamt of their activity directly. Under residence law, § 21 Abs. 5 AufenthG also applies: any licence needed to practise the profession must have been granted or at least promised. An important advantage of this provision: the three-year time limit of Abs. 4 expressly does not apply to freelancers.

These are the criteria actually used in the assessment. § 21 Abs. 1 Satz 2 AufenthG names five aspects in particular for the assessment: the viability of the underlying business idea, the entrepreneurial experience of the applicant, the amount of capital invested, the effects on the employment and training situation and the contribution to innovation and research. If you structure your business plan along these five points, you make the examination easy for the authority and avoid follow-up questions.

The IHK is not the only body involved. Contrary to a widespread assumption, no “IHK viability check” decides on your application. § 21 Abs. 1 Satz 3 AufenthG provides that the assessment involves the expert bodies for the location of the planned activity, the competent trade authorities, the professional representative bodies under public law and the authorities competent for admission to the profession. For skilled crafts, this is the Handwerkskammer; for professions organised in chambers, the relevant professional chamber. Their opinions are taken into account in the decision, but they are not binding on the Ausländerbehörde.

Settlement permit after just three years. By way of derogation from § 9 Abs. 2 AufenthG, § 21 Abs. 4 AufenthG allows the settlement permit to be granted after just three years. However, the requirement is more than the mere passage of time: you must have been self-employed for three years, the activity you currently pursue must, in particular on account of its success and its duration, give reason to expect a further sustainable development of the business, and the subsistence of you and of the family members entitled to maintenance who live with you as a family unit must be secured by sufficient income. In addition, reasons of public security or order must not stand in the way (§ 9 Abs. 2 Satz 1 Nr. 4 AufenthG). The fee is €124.00 under § 44 Nr. 2 AufenthV.

There is no statutory processing deadline. How long the procedure takes depends on the competent Ausländerbehörde and, above all, on how quickly the expert bodies involved respond. Local procedure descriptions – for example from the City of Stuttgart or the district of Soest – state up to twelve weeks. Therefore, submit any application for an extension at least eight weeks before the expiry of your title, so that the fiction of continued validity under § 81 Abs. 4 AufenthG applies and your stay remains permitted without interruption.

Check the ancillary provision on your residence title. The electronic residence title carries an annotation stating which economic activity is permitted. Only if self-employed activity is expressly permitted there may you work as an entrepreneur; permission to take up employment is not sufficient for this. If you later want to change the business purpose significantly or build a second line of business, clarify this with the Ausländerbehörde in advance.

Use free start-up advice. Industrie- und Handelskammer and Handwerkskammer offices, local economic development agencies and start-up centres generally offer an initial consultation free of charge on the business plan, legal form and financing. Because the same bodies are later involved in the procedure under § 21 Abs. 1 Satz 3 AufenthG, you learn early on which points are viewed critically in your region. The Federal Government’s official portal Make it in Germany provides additional information.

Avoid these mistakes

Common mistakes

Retirement provision from age 45 not proven. Anyone older than 45 who does not prove adequate retirement provision will, as a rule, not be granted the residence permit under § 21 Abs. 3 AufenthG – even with an excellent business plan. The consequence is a refusal, against which only a Widerspruch or legal action can help, while the company has already been founded and capital is tied up.

Business plan stays superficial. If a market analysis, a reliable cost calculation and multi-year liquidity planning are missing, the authority cannot confirm that the criteria of § 21 Abs. 1 Satz 2 AufenthG are met. In practice, this leads either to a months-long loop of requests for further documents or directly to refusal – the fee is also due in the event of a refusal.

Financing backed only by letters of intent. § 21 Abs. 1 Satz 1 AufenthG requires financing secured by equity or a loan commitment. A non-binding letter of interest from an investor, or an account balance that does not cover the capital requirements of your own business plan, is not sufficient and leads to refusal because a requirement for issuing the permit is not met.

Entering on the wrong visa. Anyone who enters on a Schengen visitor visa and then wants to switch to a residence permit for self-employment on site regularly fails, because the visa procedure has to be carried out after all. The consequence is the obligation to leave the federal territory and a complete restart of the procedure at the German mission abroad – including another visa fee of €75.00.

Applying for an extension too late. If the application is only submitted after the expiry of your title, the fiction of continued validity under § 81 Abs. 4 AufenthG no longer applies. You are then staying in the federal territory without a valid residence title, must not continue running your business and risk being requested to leave the country – with immediate consequences for current contracts and loans.

Forgetting the licence to practise. Freelancers in regulated professions often overlook that § 21 Abs. 5 AufenthG requires the licence to practise to have been granted or at least promised. Without Approbation, chamber admission or the required entry, the residence title will not be granted, and recognition procedures themselves often take several months.

Not referring to the simplified route of § 21 Abs. 2a AufenthG. Graduates of German universities and researchers who do not expressly invoke this provision are often assessed according to the stricter standards of Abs. 1. This costs weeks of processing time and can lead to a refusal, even though the simplified route would have been open to them.

Not collecting evidence of business performance. If you apply for the settlement permit after three years, you must prove that the activity, in particular on account of its success and its duration, gives reason to expect a further sustainable development of the business and that your family’s subsistence is secured by sufficient income. If tax assessment notices, annual financial statements and business evaluation reports are missing, you remain on the fixed-term residence permit and pay the extension fee again each time.

Postponing the registration of residence (Anmeldung). Under § 17 BMG, the Anmeldung at the Bürgeramt is required within two weeks of moving in. If you miss the deadline, you not only risk a regulatory fine but also delay the entire procedure: without a Meldebescheinigung, the local jurisdiction of the Ausländerbehörde is not established and the application will not be accepted.

Frequently asked questions

Questions and answers

How much does the residence permit for self-employed persons cost?

Issuing the permit costs €100.00 nationwide, an extension of more than three months €93.00 and an extension of up to three months €96.00 (§ 45 AufenthV). The Ordinance Governing Residence does not provide for a higher fee rate specifically for self-employed activity under § 21 AufenthG; the later settlement permit costs €124.00 under § 44 Nr. 2 AufenthV.

What requirements does § 21 Abs. 1 AufenthG set out?

Under § 21 Abs. 1 Satz 1 AufenthG, three requirements must be met at the same time: an economic interest or a regional need, positive effects of the activity on the economy and financing secured by equity or a loan commitment. Under Satz 2, the assessment considers in particular the viability of the business idea, your entrepreneurial experience, the amount of capital invested, the effects on the employment and training situation and the contribution to innovation and research.

Is there an age limit for self-employed persons?

There is no rigid age limit, but § 21 Abs. 3 AufenthG provides that foreigners who are older than 45 should only be granted the residence permit if they have adequate retirement provision. In practice, this proof – for example of pension entitlements, private pension insurance or assets – is the decisive hurdle for founders over 45 and a common reason for refusal.

How long is the residence permit under § 21 AufenthG valid?

Under § 21 Abs. 4 Satz 1 AufenthG, the residence permit is limited to a maximum of three years; many Ausländerbehörde offices initially grant a shorter period and only extend it once reliable business figures have been submitted. This three-year time limit expressly does not apply to freelancers under § 21 Abs. 5 AufenthG.

Do I need a business plan, and does the IHK check it?

Without a meaningful business plan with market analysis, cost calculation and financing plan, the authority cannot assess the criteria of § 21 Abs. 1 Satz 2 AufenthG, so in practice it is indispensable. The decision, however, is taken by the Ausländerbehörde: under § 21 Abs. 1 Satz 3 AufenthG, the expert bodies, the competent trade authorities, the professional representative bodies under public law and the authorities competent for admission to the profession are involved – this is participation in the procedure, not a binding viability check by the IHK alone.

Are there easier conditions for graduates of German universities and researchers?

Yes. Under § 21 Abs. 2a AufenthG, graduates of German universities as well as researchers and scientists should receive the residence permit by way of derogation from Abs. 1 if the intended self-employed activity shows a connection with the knowledge acquired during their studies or with their previous research activity. The examination of the economic interest and of the secured financing under Abs. 1 therefore does not apply – in practice, this is the most important simplified route.

What applies to freelancers in particular?

Freelancers within the meaning of § 18 Abs. 1 Nr. 1 EStG do not register a trade (§ 6 GewO); instead, they notify the Finanzamt of their activity directly. Under residence law, § 21 Abs. 5 AufenthG also requires that any licence needed to practise the profession has been granted or that its grant has been promised, such as the Approbation for doctors or admission to the bar for lawyers.

When can I apply for the settlement permit?

Under § 21 Abs. 4 Satz 2 AufenthG, the settlement permit can be granted after just three years by way of derogation from § 9 Abs. 2 AufenthG, if you have been self-employed for three years, the activity you currently pursue, in particular on account of its success and its duration, gives reason to expect a further sustainable development of the business, the subsistence of you and of the family members entitled to maintenance who live with you as a family unit is secured by sufficient income and no reasons of public security or order stand in the way (§ 9 Abs. 2 Satz 1 Nr. 4 AufenthG). The fee is €124.00 under § 44 Nr. 2 AufenthV; tax assessment notices, annual financial statements and business evaluation reports serve as proof.

How long does processing take?

There is no nationwide processing deadline – the duration depends on the competent Ausländerbehörde and, above all, on the involvement of the expert bodies. Local procedure descriptions, for example from the City of Stuttgart or the district of Soest, state a processing time of up to twelve weeks; plan for this period and submit your application for an extension well before the expiry of your title.
