Extend a residence title
Ausländerbehörde · Residence law
A temporary residence title must be extended before its expiry. Legally, the extension is not a formality: under the Residence Act (Aufenthaltsgesetz, AufenthG), the same provisions apply to it as to the initial issue (§ 8 Abs. 1 AufenthG) – so the Ausländerbehörde (foreigners authority) checks again in full whether purpose, subsistence, health insurance and the passport requirement are still satisfied.
The fee is set uniformly nationwide in the Ordinance Governing Residence (Aufenthaltsverordnung, AufenthV) and, under § 45 Nr. 2 AufenthV, amounts to €93.00 if the further stay lasts more than three months and €96.00 for an extension of up to three months. The short extension is therefore more expensive than the long one – a statement such as “from €93” is misleading. For a change of the purpose of residence, a separate fee item of €98.00 applies (§ 45 Nr. 3 AufenthV).
What matters is the time of submission of the application: if the application is made before the expiry of the title, your previous residence title is deemed to continue until the authority’s decision (deemed continuation (Fortgeltungsfiktion), § 81 Abs. 4 Satz 1 AufenthG). By contrast, there is no statutory lead time of six to eight weeks – that is a recommendation by the authorities, not a deadline. If you are late, you should still make the application immediately: § 81 Abs. 4 Satz 3 AufenthG allows the authority to order continued validity in order to avoid undue hardship.
