Applying for care aids

Pflegekasse · Consumables, equipment and jurisdiction

InformalFrom Pflegegrad 1

§ 40 SGB XI gives people in need of care an entitlement to care aids (Pflegehilfsmittel) – defined as aids that “contribute to easing care or relieving the discomfort of the person in need of care, or enable them to lead a more independent life”. The entitlement already exists from care grade (Pflegegrad) 1.

There are two types. Care aids for consumption – disposable gloves, bed-protection pads, disinfectants, protective aprons – are covered up to €42 a month; many providers deliver them as a monthly box directly to your home and bill the fund directly. Technical care aids such as a care bed, an emergency call system or positioning aids are primarily provided on loan.

For technical aids, a co-payment (Zuzahlung) applies that many people do not expect, and it is capped: “ten per cent, but no more than €25 per care aid”. If the aid is provided on loan, there is usually no co-payment – a reason to ask explicitly about borrowing it.

And the most important relief has nothing to do with money but with jurisdiction: you do not need to know whether the health insurance fund (Krankenkasse) or the long-term care insurance fund (Pflegekasse) pays. § 40 Abs. 5 SGB XI provides that “the benefit institution with which the benefit is applied for checks whether an entitlement exists against the health insurance fund or the long-term care insurance fund and decides on the approval”.

What you need

The notice (Bescheid) on the Pflegegrad

From Pflegegrad 1. This is one of the few benefits already available in full at that grade – the €42 a month applies regardless of the grade.

An informal application

One sentence is enough; many funds have a form. For consumable products, a standing application is common: you apply once and receive the delivery every month without applying again each time.

For technical aids: a medical prescription or recommendation

Helpful but not always required. A recommendation from the assessment procedure or from the advisory visit acts like an application – ask the assessor or the care professional about it.

The list of what you actually need

With the consumables box, the contents can usually be put together yourself. Choose what you actually use rather than taking a standard box – unused products use up the same budget as used ones.

The application date

Note it down. The deadline under § 40 Abs. 7 SGB XI runs from this date – three weeks, or five if the Medical Service (Medizinischer Dienst, MD) is involved – and once it has expired, the benefit is deemed approved if you have not received a reasoned notification.

Step by step

How to proceed

  1. 1

Do not worry about which fund is responsible

In practice, this is the most important rule on this page. Under § 40 Abs. 5 SGB XI the institution with which you apply must itself check whether there is an entitlement against the health insurance fund or the long-term care insurance fund, and decide. So simply submit the application – and do not let yourself be sent from one body to another.

  2. 2

Split the need: consumables and technical aids

Consumables are gloves, bed-protection pads, disinfectants, protective aprons – up to €42 a month. Technical aids are a care bed, an emergency call system, a wheelchair, positioning aids, a commode. Different rules apply to each.

  3. 3

Submit a standing application for consumable products

Apply once, receive it delivered every month. Numerous providers bill the long-term care insurance fund directly, so you neither pay upfront nor submit invoices. Put the box together according to your actual consumption.

  4. 4

Ask about loan provision for technical aids

They are primarily provided on loan, and then there is usually no co-payment. On purchase it is “ten per cent, but no more than €25 per care aid”. So ask explicitly about provision on loan.

  5. 5

    Use recommendations from the assessment

If the Medical Service recommends an aid in the assessment report, this acts like an application – you do not need to apply again. The same applies to recommendations from the advisory visit. Ask explicitly about this at the appointment; it is rarely raised unprompted.

  6. 6

    Watch the deadline

Under § 40 Abs. 7 SGB XI the Pflegekasse must decide within three weeks – five weeks if the Medical Service or a care professional is involved. If it does not inform you in writing of a sufficient reason for a delay, the benefit is deemed approved once the deadline has passed.

  7. 7

If your application is refused, lodge an objection (Widerspruch)

In writing, with a statement of reasons explaining why the aid eases care, relieves discomfort or enables a more independent life – these are the three statutory purposes. A sentence from the care professional or the doctor on this carries more weight than a general description.

For care aids for consumption, the expenditure under § 40 Abs. 2 SGB XI “must not exceed the amount of €42 per month” – and this applies from Pflegegrad 1, regardless of the grade. For technical care aids, the co-payment under subsection 3 is “ten per cent, but no more than €25 per care aid”; because technical aids are primarily provided on loan and there is then usually no co-payment, it is worth asking explicitly about borrowing. In addition, two rules that hardly anyone knows about save you work. First, jurisdiction: under subsection 5, “the benefit institution with which the benefit is applied for checks whether an entitlement exists against the health insurance fund or the long-term care insurance fund” and decides on the approval. So you do not have to make this distinction yourself – and you do not have to accept being sent from one body to another either. Second, the deadline: under subsection 7, a decision must be made within three weeks, or within five weeks if the Medical Service or a care professional is involved. If the fund cannot meet this, it must inform you of a reason in writing without delay; if it fails to do so, the requested benefit is deemed approved once the deadline has passed. So note the application date. A point about jurisdiction that explains many misunderstandings: the Pflegekasse is a separate institution, but under § 46 SGB XI it is established at the health insurance fund. You write to the same address and often speak to the same office – but legally they are two funds with two different catalogues of benefits. That is why so many benefits end up filed under the wrong one.

Good to know

Important notes

€42 a month for consumable products, already from Pflegegrad 1. The amount does not depend on the Pflegegrad.

You do not need to know which fund is responsible. § 40 Abs. 5 SGB XI obliges the institution approached to check both potential entitlements.

After three weeks without a reply, the application is deemed approved – five weeks with the Medical Service, provided no reason was given in writing.

Ask about loan provision. Technical aids are primarily provided on loan, and the co-payment then usually does not apply.

The co-payment is capped: 10%, no more than €25 per care aid.

A standing application saves you from repeating it every month, and many providers bill the fund directly.

Recommendations from the Medical Service act like an application. Ask explicitly about this at the assessment.

Put the box together according to real need. Unused products use up the same budget as used ones.

Avoid these mistakes

Common mistakes

Letting yourself be sent back and forth between the health insurance fund and the long-term care insurance fund. The institution you apply to must check both entitlements and decide.

Not noting the application date. Without it you cannot claim the three- or five-week deadline.

Buying a technical aid without asking about loan provision. With provision on loan the co-payment usually does not apply.

Applying afresh every month. For consumable products there is the standing application.

Not applying at all at Pflegegrad 1. The €42 is available in full at that grade.

Accepting a refusal without raising the three statutory purposes: easing care, relieving discomfort, enabling a more independent life.

Frequently asked questions

Questions and answers

Do I need to know whether the health insurance fund or the long-term care insurance fund is responsible?

No, and this is the most useful rule on this page. § 40 Abs. 5 SGB XI provides that “the benefit institution with which the benefit is applied for checks whether an entitlement exists against the health insurance fund or the long-term care insurance fund and decides on the approval”. So the distinction is not your problem but the funds’ problem – and binding guidelines on this have been adopted for health insurance funds and long-term care insurance funds alike. In practice this means: submit the application to whichever body you would approach anyway, and do not let yourself be turned away. Incidentally, the substantive difference behind this is the purpose: the health insurance fund pays for medical aids (Hilfsmittel) under § 33 SGB V because of illness or disability, while the long-term care insurance fund pays for those that ease care or enable a more independent life.

What do I get for the €42?

Care aids for consumption: disposable gloves, bed-protection pads, disinfectant for hands and surfaces, protective aprons and face masks. The amount of €42 a month applies from Pflegegrad 1 and is independent of the grade. In practice this usually takes the form of a monthly delivery to your home, the contents of which you put together yourself – many providers bill the long-term care insurance fund directly, so you neither pay upfront nor submit invoices. Choose according to your actual consumption: products that end up unused in the cupboard use up the same budget as those you actually need.

What does a care bed cost?

As a rule nothing or little, because technical care aids are primarily provided on loan – and if they are on loan, there is usually no co-payment. If it does come to a purchase, the co-payment is capped under § 40 Abs. 3 SGB XI: “ten per cent, but no more than €25 per care aid”. So ask explicitly about provision on loan for every technical aid – this applies equally to a care bed, wheelchair, commode, positioning aids and an emergency call system. A side benefit of the loan: maintenance and replacement in the event of a defect are also covered.

How long is the Pflegekasse allowed to take to decide?

Three weeks from receipt of the application – and five weeks if the Medical Service or a care professional is involved. This is set out in § 40 Abs. 7 SGB XI. What matters is the legal consequence: if the fund cannot meet the deadline, it must give you a sufficient reason in writing without delay. If it fails to do so, the requested benefit is deemed approved once the three or five weeks have passed. So note the application date and keep proof that the application was received – without both you cannot rely on the rule.

Are care aids available even at Pflegegrad 1?

Yes, and in full. The entitlement under § 40 SGB XI merely requires the person to be in need of long-term care, without distinguishing by grade – the €42 a month for consumable products is available at Pflegegrad 1 just as at grade 5, and technical aids can also be considered. Together with the additional relief allowance (Entlastungsbetrag) of €131 a month and the grants for improving the home environment, this is why it is worth applying for a Pflegegrad even if only grade 1 is expected. Many people with grade 1 assume they are entitled to “nothing yet” and leave these benefits unused.

Do I need a prescription from a doctor?

Not strictly required, but it helps. For consumable products the informal application, or the standing application with the provider, is usually enough. For technical aids, a medical prescription or a professional statement of reasons makes approval considerably easier. The most effective route, however, is one that hardly anyone uses: if the Medical Service recommends an aid in the assessment report, this recommendation acts like an application – you then do not need to apply separately. The same applies to recommendations from the advisory visit. Raise this explicitly at both appointments; it is rarely mentioned unprompted.

What do I do if I am refused?

Lodge an objection (Widerspruch) – in writing, within one month, and with a statement of reasons based on the three statutory purposes: does the aid ease care, does it relieve discomfort, or does it enable a more independent life? It is enough if one of these applies. A specific description works better than a general one: not “I need a care bed”, but “getting up from the flat bed is not possible without help; the carer has to lift me three times a day and has back pain as a result”. A brief statement from the GP or the care professional on exactly this point carries more weight than a stack of general documents.

Can I choose the products myself?

For consumable products, largely yes. Most providers let you choose the monthly selection, and it is worth doing so rather than taking a standard box – anyone who needs bed-protection pads but not face masks should allocate the budget accordingly, because unused products use it up just the same. Make sure the provider bills the long-term care insurance fund directly; then you do not have to pay anything upfront. For technical aids the choice is narrower: what matters is that the aid is suitable and necessary – you cannot demand a specific make, but you can argue why a simpler model is not sufficient in the particular case.
