Submit a declaration of parental custody (Sorgeerklärung)

Jugendamt (youth welfare office) · Joint custody for unmarried parents

In personAlso separately

If the parents are not married to each other at the time of the birth, at first only the mother has parental custody – as provided by § 1626a Abs. 3 BGB of the German Civil Code (Bürgerliches Gesetzbuch, BGB). The father acquires it only by one of three routes: through declarations of parental custody (Sorgeerklärungen), through marriage or through a decision of the family court (Familiengericht).

The Sorgeerklärung is the simplest of these, and at the Jugendamt it is free of charge. Incidentally, paternity acknowledgement is not enough for this: it establishes descent and creates maintenance obligations, but not parental custody. These are two separate declarations, often made at the same appointment – but still two.

One point where many people fail unnecessarily: you do not have to attend together. § 1626d Abs. 1 BGB requires that declarations of parental custody (Sorgeerklärungen) “be officially recorded” – that is, a form requirement, not simultaneous attendance. Each parent can have their declaration recorded separately, at different times and at different Jugendamt offices. Attending together is convenient, but not required.

And it is possible before the birth: § 1626b Abs. 1 BGB expressly states that the Sorgeerklärung “can already be made before the birth of the child”. For many couples this is the calmest time – and it saves having to deal with it shortly after the birth among everything else.

What you need

Identity card or passport

From each parent who makes a declaration. Since separate recordings are permitted, you do not both have to attend the same appointment – but each must show identification at their own recording.

The child’s birth certificate (Geburtsurkunde)

If the child has already been born. If the declaration is made beforehand, the Mutterpass (maternity record book) or details of the expected date are sufficient.

Paternity acknowledgement

If legal paternity is not yet established, it must be clarified first – without it, the man is not legally the father and cannot make a declaration of custody. Both recordings can take place at the same appointment; they remain two separate declarations.

For foreign documents: translations

The authorities regularly require foreign-language civil status documents (Personenstandsurkunden) in certified translation, sometimes with an apostille or legalisation. Ask in advance which form your Jugendamt accepts – this is the most common reason for a second appointment.

Step by step

How to proceed

  1. 1

Clarify whether paternity is legally established

Without legal paternity, there can be no Sorgeerklärung (declaration of parental custody). If it has not yet been acknowledged, obtain it first – the Jugendamt records this free of charge too, and if there are difficulties, the Beistandschaft (legal advisership by the youth welfare office) can help.

  2. 2

Arrange an appointment at the Jugendamt

The Jugendamt offices are responsible for recording it; no particular office is prescribed for this. When booking the appointment, say whether you also want to acknowledge paternity – both can then be prepared together.

  3. 3

Making the declarations — together or separately

You can come together or each on your own. Under § 1626d Abs. 1 BGB, only official recording is required, not simultaneous attendance. Separate declarations at different Jugendamt offices are permitted – this helps when the parents do not live in the same place.

  4. 4

Do not add conditions or a time limit

§ 1626b Abs. 2 BGB is unambiguous: “A Sorgeerklärung (declaration of parental custody) made subject to a condition or a time limit is invalid.” A declaration “until further notice” or “for as long as we live together” is therefore ineffective – and this often only becomes apparent when it actually matters.

  5. 5

    Keep the documents

You receive certified execution copies (Ausfertigungen). Keep them together with your civil status documents (Personenstandsurkunden): Kitas, schools, hospitals, banks and authorities ask for them, and there is no central custody register that anyone could consult.

  6. 6

If one parent does not cooperate: the family court

If the mother refuses to make the declaration, the father can apply to the family court under § 1626a Abs. 2 BGB to be granted joint custody. The law works here with a presumption in favour of joint custody, where the other parent puts forward no reasons against it.

At the Jugendamt, recording the declaration of parental custody (Sorgeerklärung) is free of charge, as is paternity acknowledgement – this is why this route is the usual one. A notary can also record it, but then charges under the Court and Notary Costs Act (Gerichts- und Notarkostengesetz, GNotKG); the amount depends on the Geschäftswert (value of the subject matter), and the notary may not reduce it, because they are legally obliged to charge the prescribed fees. A “cheaper notary” does not exist – anyone who wants to save money goes to the Jugendamt. On form: § 1626d Abs. 1 BGB requires declarations of parental custody and consents to “be officially recorded”. This is a form requirement and not a duty to attend: each parent can have their declaration recorded on their own, even at a different time and at a different Jugendamt. Joint custody arises as soon as both declarations exist. Under subsection 2, the recording body notifies the competent Jugendamt of this without delay. The law also contains two pitfalls: a declaration made subject to a condition or a time limit is invalid (§ 1626b Abs. 2), and it is invalid to the extent that a court has already decided on parental custody (subsection 3).

Good to know

Important notes

Without a Sorgeerklärung (declaration of parental custody), the unmarried father has no parental custody. § 1626a Abs. 3 BGB: otherwise, the mother has parental custody.

Paternity acknowledgement is not parental custody. Two separate declarations, often made at the same appointment – but one does not replace the other.

You do not have to attend together. § 1626d requires official recording, not simultaneous attendance. Separate appointments and different Jugendamt offices are permitted.

Before the birth works too. § 1626b Abs. 1 BGB says so expressly – and it is usually the calmer time.

Conditions and time limits make the Sorgeerklärung invalid. § 1626b Abs. 2. “For as long as we are together” is not a valid declaration of parental custody.

Free at the Jugendamt, not at the notary. Notary fees are set by law and not negotiable.

There is no central custody register to consult. Keep the documents – they are asked for more often than you might think.

If one parent refuses, the family court decides. § 1626a Abs. 2 BGB, with a presumption in favour of joint custody.

Avoid these mistakes

Common mistakes

Believing that paternity acknowledgement brings parental custody with it. The most common misunderstanding of all – and it often only comes to light at a hospital or during an Anmeldung (residence registration).

Cancelling an appointment because the other parent cannot make it. Separate recordings are permitted; attend individually.

Making a declaration subject to a condition. It is invalid, and this only becomes apparent when you try to rely on it.

Going to the notary without knowing about the free route. The Jugendamt records the same declaration free of charge.

Not keeping the document. There is no central register that anyone could consult.

Bringing foreign-language documents without a certified translation. The most common reason for a second appointment.

Frequently asked questions

Questions and answers

Do we both have to go to the Jugendamt at the same time?

No. § 1626d Abs. 1 BGB merely provides that “Sorgeerklärungen (declarations of parental custody) and consents … must be officially recorded” – this is a form requirement, not a duty to attend. Each parent makes their own declaration, and both can do this separately: at different times and at different Jugendamt offices, which is especially helpful when the parents do not live in the same place. Joint custody arises as soon as both declarations are validly made. Attending together is more convenient, because everything is dealt with in one appointment – but it is not necessary.

Is paternity acknowledgement not enough?

No, and this is the misunderstanding with the most serious consequences in this area. Paternity acknowledgement establishes legal descent: maintenance obligations, the law of succession and the name entered as father in the Geburtsurkunde (birth certificate) follow from it. Parental custody does not arise from this. Under § 1626a BGB, unmarried parents have joint custody only if they make Sorgeerklärungen (declarations of parental custody), marry, or the family court transfers it to them; “otherwise, the mother has parental custody”. Both declarations are often recorded at the same appointment – which is why many people believe it is one declaration. Ask explicitly what you have signed.

Can we settle this before the birth?

Yes. § 1626b Abs. 1 BGB says it in so many words: “The Sorgeerklärung (declaration of parental custody) can already be made before the birth of the child.” The same applies to paternity acknowledgement. In practice this is often the better time: you have more time, appointments are easier to get, and you do not have to deal with it among everything else in the first weeks with a newborn. Custody then takes effect with the birth. Bring the Mutterpass (maternity record book) or details of the expected date.

What does the Sorgeerklärung cost?

Nothing at all at the Jugendamt – recording the Sorgeerklärung (declaration of parental custody) is just as free of charge as recording paternity acknowledgement. A notary may record the same declaration, but then charges under the GNotKG; the amount depends on the Geschäftswert. In this case, do not look for a cheaper notary: notaries are legally obliged to charge the prescribed fees and may not reduce them – all of them charge the same for the same recording. Anyone who wants to save money should therefore go to the Jugendamt.

What happens if the mother does not agree?

Then the only path left is through the family court. Under § 1626a Abs. 2 BGB, the court grants joint parental custody on the application of one parent, and in doing so works with a presumption in favour of joint custody: if the other parent puts forward no reasons against it, and none are otherwise apparent, joint custody is assumed. How this turns out in a specific case, however, depends on the circumstances – the child’s age, the care provided so far, and the parents’ ability to communicate. A note that applies to this whole entity: a great deal here depends on the assessment of the individual case – on the specific family situation, the age and wishes of the child, the professional assessment, and the practice of the particular Jugendamt. Where this page gives no fixed deadline or figure, that is stated deliberately – an invented figure would be more harmful here than an honest answer, because decisions about children are made on that basis.

Can I make the Sorgeerklärung subject to a time limit or conditions?

No, and attempting to do so makes it invalid. § 1626b Abs. 2 BGB is unambiguous: “A Sorgeerklärung (declaration of parental custody) made subject to a condition or a time limit is invalid.” Wording such as “for as long as we live together” or “for two years for now” does not therefore lead to a limited custody, but to none at all – and this usually only becomes apparent when you try to rely on it. Under subsection 3, the declaration is also invalid to the extent that a court has already decided on parental custody.

Can we later reverse joint custody?

Not by a declaration of your own. Once joint custody has validly arisen, it cannot be ended by revocation – for that, a decision of the family court is needed, which, on the application of one parent, transfers custody wholly or partly to one parent alone. The standard applied is the best interests of the child, not the parents’ wishes. This is a deliberate difference from how it arises: joint custody is easy to create and hard to dissolve, because it concerns a legal position of the child. Seek advice before making such an application.

Where is the Sorgeerklärung registered?

The recording body notifies the competent Jugendamt of the declaration without delay under § 1626d Abs. 2 BGB. However, there is no publicly accessible custody register – nobody can look up from outside who holds custody. In practice, this means: keep the certified execution copies (Ausfertigungen) and take them with you whenever you need to prove that you hold custody. This is asked for more often than you might expect: at Kita and school registrations, at hospitals, when travelling abroad, and for banking matters for the child. The mother can obtain a Negativbescheinigung (negative certificate) from the Jugendamt if she needs to prove that no joint custody exists.
